States likely at risk
What economic nexus is
After South Dakota v. Wayfair (2018), most states adopted economic-nexus thresholds. Typically $100k in sales into that state OR 200 transactions per year. A few states are revenue-only; a few are lower.
Cross either threshold, and you must register, collect, and remit in that state. Missing states = back taxes + ~20-25% penalty when caught.
The three routing outcomes
- $500k-$1M, 3-6 states at risk - Stripe Tax. Cleanest if you already use Stripe / Shopify Payments.
- $1M+ or 8+ states at risk - Avalara AvaTax. Pricier, but handles product tax codes, exemption certificates, and multi-channel.
- Bookkeeping hygiene gap alongside the tax problem - A2X / Taxomate for Amazon/Shopify reconciliation, then Avalara for filing.
Trust
- Thresholds pulled from state Department of Revenue pages; current year.
- All three tools are affiliate partners. Routing is by your revenue + state count, not payout.
- Not tax advice. If you've already crossed thresholds in 3+ states you haven't registered in, engage a CPA for a Voluntary Disclosure Agreement (VDA) before registering cold. VDAs typically cap back-tax exposure to 3-4 years.
FAQ
Amazon collects for me - am I off the hook?
For sales on Amazon.com, marketplace facilitator laws put collection on Amazon in most states. Direct sales (Shopify) are still your responsibility.
I think I'm already past thresholds somewhere I haven't registered. What now?
Do not register cold; that triggers state questioning about prior periods. Use a CPA's Voluntary Disclosure Agreement to cap exposure.
Which states are most audit-active?
California, Texas, New York, Florida, Illinois, Washington = the big six for e-commerce. High shipment volume into any of those = treat nexus risk as live.
